Nadler: No DOMA repeal in 2010, instead focus on ENDA, DADT and UAFA

Rep. Jerrold NadlerIn an interview with DC Agenda (formerly the Washington Blade), Rep. Jerrold Nadler (D-NY) did not expect to take up his  “Respect for Marriage Act” until 2011, after other LGBT-focused legislation had been voted on, including the ENDA, DADT and UAFA.

“The Respect for Marriage Act comes up after that, maybe at the end of the next Congress, maybe afterward,” he [Nadler] said.

Nadler’s legislation would overturn DOMA, allowing the federal government to recognize same-sex marriages. It also has a “certainty provision” that would allow same-sex couples to marry in one state and still receive federal benefits even if they move to another state where gay nuptials aren’t recognized.

In lieu of passage in this Congress, Nadler said the task for supporters is to find more co-sponsors for the bill. As of Tuesday, the bill had 105 co-sponsors. Nadler predicted support would grow.

“And I think if some of these other bills pass, it’ll become more — the idea becomes less avant garde,” he said.

Nadler also introduced the Uniting American Families Act (UAFA) earlier this year, which would allow gays and lesbians to sponsor their foreign-born partners for citizenship, and is pushing for that legislation to be a part of larger immigration reform in 2010.

“I don’t know what the final comprehensive immigration reform will look like, but I remain optimistic that it will include lesbian and gay families,” he said.

In the event that comprehensive immigration reform legislation doesn’t include UAFA when it debuts, Nadler said he’s working on making sure there are votes in the House Judiciary Committee to amend the bill to include such a provision.

Nadler said he’s “hopeful” there will be enough votes for an amendment, but added “that’ll be a big fight, if necessary.”

“I haven’t taken any votes or whip counts or done any kind of that work, but certainly it will be something that we’ll have to work at and the gay community and everybody will have to be pressuring the individual members of the committee,” Nadler said. “A lot of the members of the committee, the Democratic members especially, say they’re very great friends with the gay community … and this’ll be an opportunity to show that they are, bar none.”

When asked if he would support immigration reform without a UAFA or similar provision, Nadler reponded “I hope it doesn’t come to that.”

FedEx extends protections to transgendered employees

FedEx extends protections to transgendered employeesFedEx has agreed to extend employment protections to its transgendered employees, a change in policy that comes at the request of Northstar Asset Management, Inc., which filed a resolution seeking protection against any form of job discrimination based on gender identity. Julie Goodridge, CEO of NorthStar Asset Management, Inc. said that “FedEx responded with a desire to understand and incorporate such a policy.”

“Transgender people suffer the greatest amount of discrimination in the workforce and have little recourse due to the lack of protection under state and federal law,” Goodridge noted. “While it is unfortunate that the Federal government has yet to pass an inclusive Non-Discrimination Act that includes all people, thankfully there are U.S. corporations like FedEx who are determined to protect and value all of their workers…they are leading the way potentially years ahead of Capitol Hill.”

While it is a step forward for the company, earlier this year FedEx refused to extend domestic partner benefits to its employees citing the Defense of Marriage Act.


Employment Non-Discrimination Act (ENDA) reintroduced in U.S. House

Rep. Barney FrankBarney Frank has just reintroduced the Employment Non-Discrimination Act (ENDA), and this time it includes gender-identity language. According to the Washington Blade, over 100 cosponsors  are already on board on with the measure, including lead sponsors Barney Frank (D-MA), IIeana Ros-Lehtinen (R-FL), Tammy Baldwin (D-WI), Jared Polis (D-CO), Michael Castle (R-DE), George Miller (D-CA), Mark Kirk (R-IL), John Conyers (D-MI), Todd Platts (R-PA), Rob Andrews (D-NJ), and Leonard Lance (R-NJ). From the HRC press release:

“Just like our friends, neighbors and coworkers, LGBT Americans work hard, provide for our families and contribute to our nation’s economy,” said Human Rights Campaign President Joe Solmonese.  “We all share the challenges of today’s economic downturn, but our community also faces arbitrary discrimination in the workplace, simply because of who we are and who we love.  Congress must pass the Employment Non-Discrimination Act and ensure that all Americans, regardless of sexual orientation and gender identity, get a fair chance to succeed at work.”

The Employment Non-Discrimination Act would address discrimination in the workplace by making it illegal to fire, refuse to hire or refuse to promote an employee based on the person’s sexual orientation or gender identity.  This bill would reflect the values, shared by the vast majority of Americans, that employment decisions should be based on a person’s qualifications and work ethic.

Two versions of ENDA were introduced back in 2007, the first with gender-identity language, the second without. The first bill, H.R. 2015 died in committee. The followup bill, H.R. 3685 passed the house 235 to 184, but many LGBT groups refused to support the second bill because of the exclusion gender-identity language.
